Kedudukan Pembukaan UUD NRI Tahun 1945 sama dengan pasal – pasal di dalam UUD NRI Tahun 1945.

“... maka disusunlah kemerdekaan kebangsaan Indonesia itu dalam suatu Undang – Undang Dasar Negara Indonesia,” kalimat tersebut menunjukkan bahwa negara Indonesia berdasarkan hukum dan mengharuskan terdapatnya sebuah undang – undang dasar.
