It is based on the provisions of the Civil Rights Act of 1964, and the regulations of the Equal Employment Opportunity Commission (EEOC). Title VII of the Civil Rights Act of 1964 prohibits employers from discriminating against employees on the basis of sex, race, color, origin, and religion. All employees and supervisors in the U.S. are required to undergo sexual harassment training as mandated by the federal government. Depending upon the regulations in a state, you may need a 1-hour sexual harassment training course for employees and a 2-hour course for supervisors. In some states, this training needs to be deployed within six months of an employee joining the office and two years (or every year in some states) after that.
Under the federal laws on sexual harassment, victims of sexual harassment can sue for damages as per the 1991 amendment to Title VII of the Civil Rights Act, 1964. These laws protect all public and private employees in the United States and those U.S.-based companies operating overseas. A victim of an alleged harassment case can file a complaint with the EEOC within 300 days of the incident. Complainants do not need an attorney to file a complaint. The complaint must be filed with the EEOC before filing it in the federal court.
