Who among four does not have the right to the subject property? Annotation of Section 4, Rule 74 of the Rules of Court on the property of a deceased person, a surviving spouse, and children, provides that the property shall be subject to the rights of three of the following four.



A. Heirs
B. Any person who might have been unduly deprived of his participation in the estate of the deceased
C. The Parents of the deceased
D. Creditors

When someone dies especially suddenly, they feel that everyone has the right to their property. However, it depends on the person and the other person’s relation to the deceased. Many parents believe that they should have access to their children’s property.

However, it depends on the situation of the child at the time of death. This means that the child may have been over eighteen at the time of his or her death. If they are not married at the time of their death, then the person’s parents may have the right to their property. However, if the person was married at the time of death, then the parents of the deceased may not have the right to the property.
