Both the student and the accompanying instructor or licenced driver will be held responsible for committing a traffic offence.

Ignorance of the law is not an excuse to commit such offence. The student must have passed the written test for the state before being accompanied by the instructor or licenced driver. This shows that the student is aware of the traffic laws before committing the crime so he or she will be held responsible.

The instructor will also be responsible for the crime, since he or she is there to guide and correct all mistakes and in this case, the instructor has led the student into committing a traffic offence.
