Jails are typically operated by a local government, usually a county government, and are designed to hold people awaiting trial, or for shorter sentences of incarnation following a criminal conviction. Prisons, on the other hand, are generally operated by a state's department of corrections or for federal crimes.

Prisons are for those who have committed more egregious crimes such as rape and murder. Jails are notorious for holding drivers nailed for a DUI or those held for contempt of court. Prison sentences are also longer than jail' time.'Jails are also used to hold those who cannot post bail; however, prisons are for people found guilty of crimes and sentenced to imprisonment as their punishment.
