Contract Questions and Answers (Q&A)

An independent contractor is often referred to as a freelancer because this is someone who will do work for someone without a promise that the person will be paid even if he/she does not have work. This means that a freelancer can get paid depending on the number of projects that the person has. An employee who has a contract can be paid regardless of how much work the person does.

For example, the person may have days when he would have a lot of work, but there are also days when he just has to monitor a few of the projects that are ongoing. No matter what he is working on, his pay will remain the same, and it would be dependent on what is written in the contract.

At times, people find it difficult to expressly differentiate between void agreement and void contract just because both cannot be enforced by law. Void agreement refers to a type of agreement between two or more parties that cannot be enforced by any competent court of law. This type of agreement does not have any legal support. Void contract, on the other hand, is a type of agreement between two or more people to pursue an illegal act.

First of all, the various terms and conditions of this type of contract are illegal, so it will be very difficult for it to have legal backing. For example, a business agreement between criminals or drug dealers cannot be enforced by any court of law. The void agreement is always unenforceable from the beginning to the end of the agreement. For void contract, it May come first with legal things until illegalities set in, and that makes it a void contract.

In a sense, when you make a promise to someone, you make a covenant. However, a covenant is much more than a sign because it signifies a full commitment to something or mostly to someone. However, usually a covenant is not made in writing, but instead, it is often made verbally like in a wedding ceremony. A contract, on the other hand, is mostly made in writing.

The parties come together to discuss usually a business agreement where one person is the worker, and the other person needs work done. Then they sign the contract. A covenant, on the other hand, is not signed. A contract can be verbal, but most people try to put the contract in writing so that everyone knows the terms of the contract.

Contract law imposes the agreeing parties to do their duties and to act reasonably with each other in accordance with their agreement. For example, a contract says that party A is selling their car in excellent working condition and will be allowing party B to pay every 15th of the month for 2 years. Party B is expected to pay every 15th in return to be buying an excellent running car.

Tort law, on the other hand, both parties should act reasonably with each other and they should be liable in their actions. If party B secretly scratched the bumper of the car in the first month of their ownership to get a discount, telling party A it was there since day 1 and had just noticed it, it will be taken to the court to award the compensation to the real victim.
