MADISON ------ (article 3, judicial powers) The courts refused James Madisons commission based on the provision of the Judiciary Act of 1789. McCULLOCH V. MARYLAND ------ (article 1,section 8) A maryland law required federally chartered banks to use only a special paper to print money , which amounted to a tax. McCulloch refused to handle the paper , saying that the states could not tax the federal government. PLESSY V. FERGUSON ------ (14th amendment) A lousiana law made seating seperate for whites and african americans. Herman Plessy declared that his righs were violated in the 14th amendment equal protection clause. BROWN V. BOARD OF EDUCATION ------ ( 14th amendment) 10 Year old girl, linda brown, couldnt go to school bc she was african american. This violated the equal protection clause. ROE V. WADE ------ (9th amendment) A texas woman challenged a state law against abortion. The state couldn't interfere without breaking her privacy rights. MAPP V. OHIO ------ (4th and 14 th amendments) Mapp's home was raided without a warrant.Searches had to to be reasonable and her conviction was repealed. MIRANDA V. ARIZONA ------ (5th, 6th, 14th, amendment) Ernesto Miranda was arrested for kidnapping and sexual assault. He wanted to be warned prior to any questioning and has the right to rimain silent and the right to an attorney. GIDEON V. WAINWRIGHT ------ (6th amendment) Gideon was ruled guilty his first court appreance but was denied a counsel in his court case due to a flordia law. Gideon later on sent for the Judicial Court and was reappointed a new case.Later he had a counsel and was found not guilty. TINKER V. DES MOINES ------ (1st amendment) Schools must show a possibility "substantial disruption" before free speech can be limited.(wearing black arm bands. ENGEL V. VITALE ------ (1st amendment) The state board of regents of new york required the recitation of a 22- word prayer at the beginning of school,this violated the 1st amendments clause. (found unconstitutional TEXAS V. JOHNSON ------ (1st and 14th amendment) Johnson had set fire to an American flag during an anti-Reagan demonstration at the Republican National Convention in Dallas in 1984. He was protected by the 1st and 14th amendment. FURMAN V. GEORGIA ------ (8th amendment) Questions of racial imbalances in the use of death sentence by state courts. Many states rewrote their death-penalty statues. NEW JERSEY V. TLO ------ (4th and 14th amendment) A new jersey student denied an accusation that she had been smoking in the school. She filled that the evidence against her was such as an "unreasonable" search. She was denied from courts stating that the school had a right to " legitimate need to maintain an enviroment can take place".
